The Importance Of Trademark

In today's market everyone wants to stand out in the crowd of competitors. Trademark is the best way to do this. A trademark is a distinctive sign or indicator which can be used by an individual, business organization, and/or other legal entity. This provides a unique identification to the products and/or services offered by such an entity. It also distinguishes a product or service from similar competitors.

A trademark is considered an intellectual property. The trademark usually comprises a name, word, phrase, symbol, design, logo, image, or a combination of all these things. A range of non-conventional trademarks is also there that do not comprise of any of the above.

A trademark need not be registered, but registration has its benefits. A registered trademark's owner has a right to start legal proceedings for trademark infringement. This prevents any unauthorized use of that particular trademark.

Although, a common law trademark's owner is also allowed to file a suit, only a registered trademark can be protected within the geographical area of its use. It can also be protected in those geographical areas where it expects some expansion.

Most of the countries, all over the world, presently register and protect the trademarks. The regional or national offices of these countries maintain a Trademarks Register. This register contains the full information of all renewals and registrations application. It facilitates a search, examination, and any potential opposition by any third party.

There is no need to make a separate registration with each regional or national office. This is because a system of international registration of marks is administered by the world intellectual property organization. This registration system is governed by two treaties: the first one is the Madrid Agreement. It concerns the International Registration of Marks and the Madrid Protocol.

This system of registration can help a person who has a link with any country that comes under any of these treaties or both of them. The link could be through nationality, domicile, and/or establishment. Such a person can obtain an international registration that has an effect in some or all the companies of this union. This advantage is on the registration's basis or on the basis of the application, with the trademark office of the country, to which the person is linked.

As of today, 60 or more countries can provide these benefits to the people linked to them.

A trademark, if popular, can turn a company's fortune, for the better. Many companies in the world today are just known by their trademarks. This has given them an edge over their competition. So, a good trademark can give a company or a business a boost that it yearns for.
